Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and GetAppNiche ("GetAppNiche", "we", "us", or "our"). They govern your access to and use of the GetAppNiche website at getappniche.com, the web application at app.getappniche.com, and all related features, data, and services (together, the "Service"). Please read them carefully. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that entity to these Terms.

1. Acceptance of these Terms

By creating an account, subscribing to a paid plan, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not access or use the Service.

2. Description of the Service

GetAppNiche is a SaaS web application that provides App Store (iOS) market intelligence for indie founders, marketers, and ASO teams. Features include estimated revenue and downloads, keyword tracking and ASO scoring, review monitoring and analysis, competitor ad and creator intelligence, and screenshot tooling.

All metrics, estimates, scores, rankings, and projections produced by the Service are heuristic and informational only. They are derived from modeling and publicly available signals, are not guaranteed to be accurate or complete, and must not be relied upon as financial, investment, business, or legal advice. We are continually improving the Service and may add, change, or remove features at any time. We may also introduce or adjust the usage limits associated with your plan.

3. Eligibility and accounts

To use the Service you must be at least 18 years old and capable of entering into a binding contract. You may register with an email address and password, or by signing in with Google (Google OAuth).

  • Accurate information. You agree to provide accurate, current, and complete information when you register, and to keep it up to date.
  • Account security. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at yaroslav91@gmail.com if you suspect any unauthorized use.
  • One person per account. Each account is for a single individual. You may not share, sell, transfer, or allow others to use your credentials, and you may not maintain multiple free accounts to circumvent plan limits.

4. Subscriptions, billing, and cancellation

The Service offers paid plans. The paid plans are Pro Monthly at $39 per month and Pro Yearly at $348 per year ($29/month), each with a 3-day free trial. All prices are in U.S. dollars and exclude any applicable taxes, which may be added at checkout.

Payments are processed by our payment provider, Stripe. We never see or store your full payment card number. By providing payment details, you authorize us and Stripe to charge the applicable fees.

  • Free trial. A paid plan may include a free trial. Unless you cancel before the trial ends, your plan will automatically convert to a paid subscription and the applicable fee will be charged.
  • Auto-renewal. Subscription plans renew automatically at the end of each billing period (monthly or yearly) at the then-current rate until you cancel.
  • Price changes. We may change subscription pricing. We will give you reasonable advance notice, and any change takes effect at the start of your next billing period. Continuing to use the Service after a price change takes effect constitutes acceptance of the new price.
  • Cancellation. You may cancel an auto-renewing subscription at any time through the Stripe billing portal accessible from your account. Cancellation stops future renewals; your access continues until the end of the current paid period.
  • Refunds. Refund eligibility, including our 14-day money-back guarantee and statutory withdrawal rights, is described in our Refund Policy. A refund, or a lost chargeback or payment dispute, will revoke your Pro access.

5. Acceptable use and prohibited conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not, and must not permit anyone else to:

  • Access, query, or scrape our API or data beyond the limits of your plan, or use automated means to circumvent rate limits, quotas, or access controls;
  • Resell, sublicense, redistribute, or commercially exploit the Service or any data obtained from it, except as expressly permitted by your plan;
  • Copy, decompile, reverse engineer, or attempt to derive the source code or underlying models of the Service, except to the limited extent that such restriction is prohibited by applicable law;
  • Use the Service for any unlawful, infringing, deceptive, or harmful purpose, or in violation of any third party's rights or any applicable law or regulation;
  • Interfere with, disrupt, probe, or compromise the integrity, security, or performance of the Service or its infrastructure, or attempt to gain unauthorized access to any account, system, or data;
  • Introduce malware or other harmful code, or impose an unreasonable or disproportionately large load on our systems.

We may investigate and take appropriate action against any suspected violation, including suspending or terminating access as described in Section 12.

6. Intellectual property and license to use

The Service — including its software, design, text, graphics, datasets, models, and the GetAppNiche name and logo — is owned by GetAppNiche or its licensors and is protected by intellectual property and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal business or personal purposes, subject to these Terms and your plan limits. No rights are granted other than those expressly set out here.

Any feedback or suggestions you provide about the Service are voluntary, and we may use them without obligation or compensation to you.

7. Third-party services and your data

The Service relies on third-party providers, including Stripe (payments), Google (OAuth sign-in and Google Analytics 4), Amazon Web Services (transactional and marketing email), DigitalOcean (hosting), and Cloudflare (DNS and content delivery). Your use of features that depend on these providers may also be subject to their terms. The Service may also contain links to third-party websites or resources that we do not control and are not responsible for. How we collect and handle your information is described in our Privacy Policy.

8. Data-accuracy and third-party disclaimer

The estimates, metrics, scores, rankings, and other analytics provided through the Service are informational only and are provided on an "as is" basis. They are heuristic in nature, may be inaccurate or incomplete, and may change without notice. Nothing in the Service constitutes financial, investment, business, or legal advice, and you are solely responsible for any decision you make or action you take in reliance on it. You use the Service and all of its outputs entirely at your own risk.

GetAppNiche is an independent service and is not affiliated with, endorsed by, or sponsored by Apple Inc.. "App Store", "iOS", "Google Play", and all related names, marks, and logos are the property of their respective owners and are used here only for identification and descriptive purposes.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL DATA AND ESTIMATES IT PROVIDES ARE FURNISHED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL SUCH WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any data, metric, or estimate it provides will be accurate, current, complete, or reliable. No advice or information, whether oral or written, obtained from us or through the Service creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GetAppNiche WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON THE ESTIMATES, METRICS, OR DATA PROVIDED BY THE SERVICE. YOU USE THE SERVICE AND ALL OF ITS OUTPUTS ENTIRELY AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID TO GetAppNiche IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS (USD 100).

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. In such cases, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless GetAppNiche from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

12. Termination and suspension

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, in whole or in part, at any time and without liability, if you violate these Terms, if we are required to do so by law, or if your continued use poses a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or within the Service. Changes take effect when posted unless stated otherwise. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

14. Governing law and disputes

These Terms are governed by applicable law, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the operator's place of business, except where applicable consumer-protection law gives you the right to bring proceedings in your place of residence. Nothing in these Terms limits any mandatory statutory rights you have as a consumer.
